
The DUI laws in California are lengthy and extremely complex. At the core, however, there are two basic drunk driving laws. The first, found in Section 23152(a) of the California Vehicle Code, simply makes it unlawful to drive a vehicle while under the influence of alcohol or drugs or a combination of the two. The legal definition of "under the influence" is essentially impairment to the degree that the individual cannot operate a vehicle in a safe manner. The second offense, found in Section 23152(b), consists of driving a vehicle while having a blood alcohol concentration of .08% of higher.
The Vehicle Code contains many other statutes concerning such matters as second DUI offenses, felony drunk driving (DUI with injury or death), criminal penalties and license suspensions and revocations.
